Public Review of a Proposed Activity in a 100-Year Floodplain and Wetland



To: All interested Agencies, Groups and Individuals

This is to give notice that Smith County has determined that the following proposed action under Texas Capital Fund Grant (funding pending), is located in Zone A of the 100-year floodplain and wetland, and the County will be identifying and evaluating practicable alternatives to locating the action in the floodplain and wetland and the potential impacts on the floodplain and wetland from the proposed action, as required by Executive Order 11988 and/or 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands.

The proposed project will provide infrastructure in the form of natural gas improvements in support of Sanderson Farms, Inc. for construction of a poultry processing plant and a wastewater treatment facility. The improvements shall consist of the transmission pipeline tap, retail gas utility provider gate station and valve components, and 6,850 linear feet of 6-inch diameter plastic natural gas service line.

The proposed natural gas system infrastructure will be constructed within FM Road 2015 ROW, commencing approximately 2,300 linear feet north of the intersection of FM 2015 and CR 313-East at a point where an existing natural gas transmission pipeline operated by Enbridge Pipeline Co. crosses FM 2015. At that point, the Enbridge transmission pipeline will be tapped for connection to a proposed new 6-inch diameter plastic CenterPoint natural gas service line that will be extended from the Enbridge tap south along FM 2015 a distance of approximately 6,850 linear feet to a planned customer station on the eastern boundary of the Sanderson Farms 572.44 acre tract project site.

The poultry processing plant and wastewater treatment facility will be constructed on a 572.44 acre tract located north of Interstate Highway 20 on FM 2015, within Smith County Census Tract 0017.00, Block Group 2.

The proposed project is located in northeast Smith County, Texas. Approximately 24.67 acres of the project is located in Zone A of the 100-year floodplain and approximately 38 acres of the project is located in the wetland.

There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplain and wetland, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains and wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains and wetlands, it must inform those who may be put at greater or continued risk.
