NOTICE OF HEARINGS

Notice is hereby given that public hearings will be held in Council Chambers, City Hall, 212 N. Bonner, Tyler, Texas, by the Planning and Zoning Commission of the City of Tyler, Texas, on Tuesday, May 7, 2019, at 1:30 p.m. and by the City Council on Wednesday, May 22, 2019 at 9:00 a.m. for the purpose of considering the following:

ZONING:

1. Z19-008 SMITH TEMPLE CHURCH OF GOD IN CHRIST, HABITAT FOR HUMANITY OF SMITH COUNTY, COLEMAN CHARLES ESTATE, JACKSON LANIE & ROBERT (2701 AND 2704 DEPRIEST AVENUE, 2505 WALTON ROAD, 13.07 ACRE TRACT OF LAND)
Request that the Planning and Zoning Commission consider recommending a zone change from R-1B, Single-Family Residential District to R-MF, Multi-Family Residential District on Lots 14-19, 31, 33, 15 and 24 of NCB 852-Z, five lots containing approximately 19.32 acres of land located east of the northeast intersection of Depriest Avenue and Walton Road (2701 and 2704 Depriest Avenue, 2505 Walton Road, 13.07 acre tract of land). The applicant is requesting the zone change to allow for the development of 200 apartment units.

2. Z19-009 VALLE LEONEL & WALBERTO AND JM EAGLE CAPITAL TRUST LLC (1810 AND 1812 NORTH ROSS AVENUE)
Request that the Planning and Zoning Commission consider recommending a zone change from R-2, Two-Family Residential District to R-1D, Single-Family Attached and Detached Residential District on Lots 7 and 8 of NCB 543, two lots containing approximately 0.33 acres of land located at the northwest intersection of North Ross Avenue and West Nutbush Street (1810 and 1812 North Ross Avenue). The applicant is requesting the zone change in order to allow for a property line to be relocated.

3. Z19-010 HERITAGE ACQUISITION COMPANY LLC (4405 TYLER PARK DRIVE)
Request that the Planning and Zoning Commission consider recommending a zone change from R-MF, Multi-Family Residential District to C-1, Light Commercial District, on an approximately 2.2 acre portion of Lot 3-E, of NCB 1554-B, one lot totaling approximately 6.97 acres of land located east of southeast intersection of Rice Road and Old Jacksonville Highway (4405 Tyler Park Drive). The applicant is requesting the zone change to allow for a commercial office development.

4. Z19-011 LETC VENTURES LLC (420 OAKLAND AVENUE AND 600 REEVES STREET)
Request that the Planning and Zoning Commission consider recommending a zone change from M-2, General Industrial District to C-2, General Commercial District on Lots 5 and 6 of NCB 74, two lots containing approximately 2.42 acres of land located at the southeast intersection of Oakland Avenue and Noble Street (420 Oakland Avenue and 600 Reeves Street). The applicant is requesting the zone change to allow for retail uses with outdoor eating and entertainment.

5. PD19-008 FAUST ERIC (602 AND 604 FRAZIER STREET)
Request that the Planning and Zoning Commission consider recommending a zone change from R-MF, Multi-Family Residential District to PMF, Planned Multifamily Residential District with site plan on Lots 52 and 53, of NCB 679, two lots containing approximately 0.47 acres of land located west of the northwest intersection of Turtle Creek Drive and Frazier Street (602 and 604 Frazier Street). The applicant is requesting the zone change to allow for an eight unit apartment complex.

6. PD19-009 ALLEN ROBERT H TESTAMENTARY TRUST (8667, 8851 AND 9101 SOUTH BROADWAY AVENUE)
Request that the Planning and Zoning Commission consider recommending a zone change from AG, Agricultural District to PMXD-1, Planned Mixed-Use District with written narrative on Tracts 1D, 1E and 1F of A-825, three tracts of land containing approximately 86.60 acres of land located at the southwest intersection of South Broadway Avenue and West Cumberland Road (8667, 8851 and 9101 South Broadway Avenue). The applicant is requesting the zone change to allow for a mixed-use development.

7. C19-002 TRINITY MOTHER FRANCES HEALTH SYSTEM (PORTION OF SOUTH BEVERLY STREET AND EAST NOBLE STREET, UNIMPROVED ALLEY)
Request that the Planning and Zoning Commission consider recommending the closure of an improved portion of right-of-way known as South Beverly Street connecting to Noble Street and an alley. The west side of the right-of-way is adjacent to Lot 9A of NCB 72. The east side is adjacent to Lots 1A, 6B, 7A and 8 of NCB 161A and Lot 6E of NCB 73. Also, closing a portion of East Noble Street adjacent to Lot 10, 11, 6, 5 and 9A of NCB 72 on the north side and Lot 6E of NCB 73 on the south side. The alley right-of-way is adjacent to Lots 1A, 2A, 13A and 14A of NCB 72 on the north side, Lot 9A of NCB 72 on the east side, Lots 5, 6 and 12 of NCB 72 on the south side and South Beckham Avenue on the west. The applicant is requesting the closure in order to utilize the road as a driveway with parking.

8. S19-003 HUDSON MEOCHA WILLIAMS (1812 ROBBINS STREET)
Request that the Planning and Zoning Commission consider recommending a Special Use Permit (SUP) approval on Lot 17 of NCB 577, one lot containing approximately 0.20 acres of land located east of the southeast intersection of Academy Avenue and Robbins Street (1812 Robbins Street). The applicant is requesting the SUP to allow for a child home daycare.

9. S19-002 SBA PROPERTIES, INC (311 EAST NINTH STREET)
Request that the Planning and Zoning Commission consider recommending a Special Use Permit amendment on Lot 2 of NCB 277P, one lot containing 0.90 acres of land located at the southwest intersection of East Ninth Street and Donnybrook Avenue (311 East Ninth Street). The applicant is requesting the amendment to remove an existing 130 feet tower and replace it with a 110 feet monopole tower.
